1. Acceptance of Terms

By accessing or using the ClearMind application ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. AI Features and Limitations

ClearMind utilizes advanced Artificial Intelligence (AI) models, including Google's Gemini, to process text and audio commands.

  • AI Content: You acknowledge that AI-generated responses and task interpretations may occasionally be inaccurate, incomplete, or unexpected. You should verify all task interpretations before relying on them.
  • No Professional Advice: AI suggestions are provided for informational purposes only and do not constitute professional, legal, or financial advice.
  • Audio Processing: When you use voice features, your audio data is transmitted to AI providers for processing. By using these features, you consent to this transmission and processing.

3. Use of the Service

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

  • You must be at least 13 years old to use the Service.
  • You agree not to use the Service for any illegal or unauthorized purpose.
  • You may not attempt to reverse engineer or bypass any security features of the Service.

4. Subscriptions and Payments

Certain features of ClearMind require a paid subscription. Subscriptions are managed through the Apple App Store or Google Play Store. All payments are subject to the terms and conditions of the respective app store. ClearMind is not responsible for any billing errors or disputes handled by the app stores.

5. Privacy and Data

Your privacy is critical to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose your personal information. By using the Service, you acknowledge that your data may be stored and processed in the cloud (via Convex and our AI partners).

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ClearMind and its licensors.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARMIND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OR INABILITY TO USE THE SERVICE; (II) ANY AI-GENERATED CONTENT OR INTERPRETATIONS; OR (III) UNAUTHORIZED ACCESS TO YOUR DATA.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the company is registered, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to modify or replace these terms at any time. We will provide notice of any significant changes by posting the new Terms of Service on this page.
